1. Applicable legal framework
MRC’s services are governed by Mexico’s Federal Consumer Protection Law (LFPC) and other applicable provisions. When the property is intended for housing, the NOM-247-SE-2021 standard also applies; for non-residential properties (e.g., commercial premises), the LFPC’s general information and truthfulness obligations apply. Where applicable, MRC will comply with anti-money laundering / KYC duties under LFPIORPI.
2. Nature of the service
MRC is not the owner of listed properties; it acts as an intermediary between owners and prospective buyers. MRC does not receive the property price through this website; payments are made with the owner/developer or the notary public.
3. Property information
Information (price, sizes, location, images, availability) is provided by the owner or legal representative and may change without prior notice.
Images, renders, mockups, and staged environments are illustrative.
For plots/land: the interested party must verify land use, utility feasibility (water, power, sewage), access/roads, topography/flood risk, environmental/community restrictions, and encumbrances.
For commercial premises or other non-residential uses: verify commercial/mixed land use and relevant licenses/feasibilities.
MRC does not guarantee capital gains, returns, timelines, or permits; any projection is reference-only.
4. Suggested minimum documentation
Before reserving/signing, the interested party should receive from the owner: title evidence, IDs and powers of attorney, plans/sketch, applicable regime/certificates, municipal guidelines, and a full cost breakdown (taxes, fees, notarial, utilities, maintenance).
5. Official channels & security
All dealings must be made exclusively through the contact channels shown above. MRC is not liable for dealings with unauthorized third parties. MRC may request KYC and refuse transactions if there is no evidence of the lawful origin of funds.
6. MRC Incentive Program
A permanent promotion with monthly rotation, communicated directly to prospective clients via official channels (email, WhatsApp, and monthly materials).
Property scope. Applies to any property type: condominiums, apartments, villas, houses, plots/land, and commercial premises.
Definitions.
Eligible transaction:
Direct sale managed by MRC, or
A transaction that generates a direct commission in favor of MRC.
Incentive: The product/service publicized in the monthly materials.
Economic cap of the incentive. The amount invested by MRC in the incentive (its commercial value including VAT) shall not exceed 10% of the gross commission effectively received by MRC for the transaction. If a publicized incentive exceeds that cap, MRC may adjust or replace it with another of equivalent value without exceeding the 10%.
Mechanics & conditions.
a) Term & rotation. The promotion is permanent and rotates monthly; the current incentive and its conditions are stated in the monthly message/document.
b) Eligibility. Adults who close an eligible transaction for which MRC’s gross commission has been settled and received.
c) Limit. One (1) incentive per buyer and per transaction. Not transferable or redeemable for cash; not combinable with other promotions.
d) Stock & replacement. Subject to availability; if out of stock, MRC may replace with an item/service of equivalent commercial value (respecting the 10% cap). Models/brands may vary.
e) Delivery. Within 30–60 calendar days, counted from the confirmation of the transaction and MRC’s receipt of the gross commission. Delivery to the buyer’s address in Mexico or to an agreed pickup point, against ID and acknowledgment.
f) Warranty/support. As provided exclusively by the incentive’s manufacturer/supplier. MRC does not cover installation, setup, consumables, data plans, electricity, or alterations.
g) Taxes. Any taxes arising from the incentive are borne by the beneficiary.
h) Financing. The promotion does not condition the choice of any financing provider; the client is free to choose. It is not a sweepstake or lottery.
7. Advertising, scope, and precedence of information
7.1 Informational nature of advertising. Any ad, graphic piece, WhatsApp/email message, or promotional material from MRC is informational and does not constitute a binding offer or a guarantee of conditions, features, prices, availability, timelines, equipment, or views. Definitive information is that set in writing in the relevant contractual documentation and in these Terms & Conditions.
7.2 Precedence of Terms & Conditions. In case of discrepancy between advertising and these Terms & Conditions, these Terms & Conditions prevail. The current version shows a last-updated date and can be consulted at mayanrivieracondos.com (EN) and es.mayanrivieracondos.com (ES).
7.3 Source and variability of information. Property data (price, sizes, images, location, availability, specifications) are provided by owners or their agents and may change without prior notice. MRC may update, correct, or withdraw information for errors, owner changes, or authority requirements, without liability.
7.4 Images, renders, environments. Images, renders, mockups, plans, staged environments, and context photos are illustrative and may not correspond to specific units, exact scales, furniture, finishes, or final equipment. Visual differentiators do not guarantee permanent views or rights over areas/elements not included in the title or contract.
7.5 Measurements, distances, times. Areas, boundaries, distances, and travel times are approximate, calculated with reference tools and may vary due to construction, layout, traffic, seasons, closures, or local conditions. The interested party must verify on-site and with competent authorities.
7.6 Projections and expectations. MRC does not guarantee capital gains, returns, occupancy, income, permits, licenses, feasibilities, delivery times, or investment outcomes. Any projection or comparison is reference-only and may change with market or regulatory conditions.
7.7 Errors & omissions. Materials may contain typographical errors or omissions. MRC may correct such errors/omissions and update information without additional liability. For clarifications or corrections, write to ventas@mayanrivieracondos.com.
7.8 Incentives & promotions. The MRC Incentive Program described in Section 6 is permanent with monthly rotation, communicated directly through official channels and limited to transactions meeting its mechanics and restrictions, including the 10% cap of MRC’s gross commission effectively received for the incentive’s value (incl. VAT). Models, brands, and stock are subject to availability and may be replaced with equivalent commercial value. Delivery follows the timelines and conditions of Section 6. The promotion is not a sweepstake or lottery and does not condition financing choices.
7.9 Third parties & trademarks. Trademarks, logos, and trade names shown belong to their owners and are used for identification. Their appearance does not imply sponsorship, affiliation, guaranteed availability, support, or functional equivalence.
7.10 No financial/urban planning advice. Advertising does not constitute legal, tax, financial, urban planning, environmental, or technical advice. The interested party should perform due diligence with trusted professionals and competent authorities.
7.11 Advertising legal regime. All MRC commercial communications are governed by the LFPC and, when the subject is housing, by NOM-247-SE-2021 as applicable. For non-residential properties, the LFPC’s general obligations apply.
7.12 Requesting documentation. Before reserving or signing, the interested party may request supporting documentation (as applicable): title evidence, plans/sketches, municipal guidelines, applicable regime, and cost breakdown (taxes, fees, notarial, utilities, maintenance), to obtain complete and verifiable information.
8. Privacy & cookies
MRC processes personal data to contact users and perform services. See the Privacy Notice (ES) and Privacy Notice (EN) at the links above; there you will find purposes, transfers, retention periods, ARCO rights, and consent revocation. The Cookie Policy is governed by those notices.
9. Data retention
Information is retained for the necessary or legal periods (tax/AML/contract). Afterwards, it will be blocked and deleted per applicable regulation.
10. Comments & moderation
Comments submitted on the site may be subject to automatic spam detection and moderation for legal compliance.
11. Intellectual property
Website contents (texts, logos, graphics, photos, materials) are owned by MRC or licensed. Unauthorized reproduction, distribution, or use is prohibited.
12. Liability
MRC will not be liable for: (i) the user’s investment decisions; (ii) inaccurate or missing third-party information; (iii) transactions carried out outside official channels; (iv) force majeure or third-party failures.
13. Final provisions
Severability. If any clause is invalid, the remainder stays in force.
Language. The Spanish version prevails; the English version is a reference.
Jurisdiction. These Terms are governed by the laws of the United Mexican States; for judicial purposes the parties submit to the competent courts of Quintana Roo, Mexico, waiving any other forum.
Versioning. This page/document shows version and date; MRC may update it and will publish the current version.
